Bloodborne Pathogen Requirements by State

State-by-state BBP certification rules for tattoo artists, piercers, and body art professionals — who needs it, how often to renew, and who oversees compliance.

Every state has its own take on bloodborne pathogen training — some mandate specific annual renewals, some defer to OSHA's federal standard, and some layer on additional requirements for body art practitioners specifically. Getting this wrong isn't just a compliance risk; it's a license risk.

Below are the requirements for three states where body art regulation is particularly active. The underlying federal baseline — OSHA 29 CFR 1910.1030 — applies to all states and requires annual BBP training for any worker with reasonably anticipated exposure to blood or OPIM (other potentially infectious materials).

Minnesota

Oversight: Minnesota Board of Cosmetologist Examiners (MBCE)
Renewal
Annual
Framework
BBP + Infection Control
Applies To
Body Art Practitioners

Minnesota requires licensed tattoo artists, body piercers, and permanent cosmetic technicians to complete annual bloodborne pathogen training meeting OSHA's 29 CFR 1910.1030 standard. The MBCE oversees body art practitioner licensing and mandates documented infection control training as a condition of license renewal. Studios must maintain training records on-site and make them available for inspection.

Oregon's Health Licensing Office regulates body art practitioners, tattoo artists, and cosmetology professionals who perform skin-penetrating services. Annual BBP training is required as part of license renewal, covering OSHA-compliant bloodborne pathogen standards plus Oregon-specific sanitation and infection control rules. Oregon HLO audits studios for training documentation compliance.

California's Safe Body Art Act (Health & Safety Code §119300–119328) requires all tattoo artists, body piercers, and permanent cosmetic technicians to complete annual bloodborne pathogen training from an approved provider before receiving a body art practitioner registration.
